TERMS OF BIKE HIRE

General
These terms and conditions apply between Lewes Cycleshack Limited Trading as Stanmer Park Bike Hire, (abbreviated to SPBH or referred to as We) and the lead person hiring, (referred to as You) and/or any other member(s) of your party and/or any other persons using SPBH equipment. The use of the word “Equipment” refers to all items hired and includes cycles, helmets, locks and/or any other items owned by SPBH. This agreement and the rights of the parties under it shall be governed by English law.

Deposit
Proof of identification will be requested when hiring Equipment, (e.g. a driving license, passport, photo I.D., etc.). We reserve the right not to hire to an individual. A security and/or damage deposit is required when hiring in the form of credit or debit card pre-authorisation. These details are stored securely and are cancelled upon return of the Equipment in a satisfactory condition. You are responsible for any damage and any repair costs will be deducted from the above deposit.

Security
You are responsible for the security of the equipment for the period of hire. The replacement costs will be deducted from the security deposit.

Returns
Equipment booked and paid for in advance is reserved for You and will be available for collection at the time you have booked. All Equipment must be returned to the place from which it was issued at the end of the hire period, unless otherwise agreed. This time is recorded on the front of the “Equipment Hire Agreement” form. Late returns incur a charge of £10 per hour or part hour. Additional days are charged by the daily hire rate.

Cancellation
In the event of a cancellation of your booked and paid for Equipment, please contact us. We are happy to reschedule the hire date, providing the Equipment is available on such a date. This is valid for 12 months from the original hire date. Alternatively, if We are able to re-hire the Equipment on the original hire date, We can offer You a full refund. We cannot offer refunds under any other circumstances. Exceptions to this policy cannot be made for any other reason. The above paragraph also applies to Equipment returned early.

Insurance
We strongly recommend that You obtain suitable travel or activity insurance to cover unexpected costs due to illness, accident, lost luggage, interruption or cancellation, etc. Overseas residents must obtain insurance cover in their home country. SPBH is covered by public/products liability insurance. This does NOT cover You for injury and/or accidents whilst using the Equipment.

Helmets
Helmets are provided free of charge and you must use them at all times. Adults who decline our offer of a free helmet must sign a Helmet Waiver declaration. All persons aged 17 or younger MUST wear a helmet whilst cycling.

Safety
Safe cycling is dependent on your alertness and good judgement. Please cycle sensibly, with respect for others and the natural habitat. You are expected to follow the Highway Code – in particular the ‘Extra Rules for Cyclists’. Anyone cycling in a discourteous or unsafe manner will have the Equipment re-possessed with no refund of the hire charge(s).

Cycling can be dangerous and has risks involved. By agreeing to these terms and conditions You declare to be in good health and are not suffering any medical conditions or disability that is likely to adversely affect normal control of the Equipment. You also agree to:
– Cycle safely and in a controlled manner at all times.
– Not undertake any manoeuvres that are beyond your skills or beyond the design purpose of the Equipment.
– Not ride on pavements or footpaths, unless it is signed telling You may do so.
– Warn pedestrians politely as You approach them from behind.
– Be courteous to motorists and other road users, especially horses.
– Start braking early in poor weather conditions, such as rain, mud, ice, snow, fog, etc.
– Not cycle after dark, as your cycles are not fitted with lights.
– Not cycle under the influence of alcohol, drugs or medication that could affect your ability to ride safely.
– Control your speed carefully, especially on all down hills or descents and do NOT RACE.

If You suspect there is a fault with the Equipment, please contact SPBH immediately. We offer a repair or replacement service, just return to the kiosk. Do not attempt to repair the Equipment yourself if You suspect it has a fault.

SPBH, its employees and/or directors cannot be held liable for any injury to You and/or any injury or damage to a third party.
